MARIJUANA TRAFFICING IN IDAHO

These days it can be rather easy to
catch a marijuana trafficking charge in Idaho. At the time I am writing this article
Idaho is one of only two states which has no tolerance for any marijuana use.
What that means is if you are traveling through Idaho be careful what you’re
bringing with you from other states.
Not all Marijuana brought into the
state is considered “trafficking.” Trafficking is defined as “any person that
knowingly brings into Idaho, or who is knowingly in actual or constructive possession
of, one (1) pound of marijuana or more, or twenty-five (25) marijuana plants or
more…” What this basically means is that a felony marijuana trafficking charge can
simply be possession of a pound of marijuana or 25 plants.

The penalties for trafficking are
serious. In Idaho, if you possess up to 1 pound and less than five pounds or if
it is 25 plants and less than 50 plants; if you are found guilty you must spend
at least one year in prison and fined not less than $5,000.00. If you possess
five pounds or more put less than 25 pounds, or more than 50 marijuana plants
but less than 100 plants then you could be sentenced to a minimum of 3 years in
prison and fined more than $10,000. If you possess 25 pounds or more or more
than 100 plants you can be sent to prison for a mandatory minimum of 5 years
and fined not less than $50,000.
Since these charges carry mandatory
minimum’s and hefty jail fines it’s especially important to get quality
